18 U.S.C. §2257 exemption statement

Dirty Talk Search, LLC does not produce any visual depiction of actual or simulated sexually explicit conduct, and the record-keeping requirements of 18 U.S.C. §2257 and §2257A, and of 28 C.F.R. Part 75, do not apply to this website.
What we actually do
A search engine over transcripts of publicly available online video. We generate text transcripts, index them, and return timestamped links that send the user to the video on the third-party site that hosts it. We do not produce, host, or serve video.
We do not create, film, photograph, direct, edit, upload, host, or serve any video or image depicting sexually explicit conduct. We do not select or arrange the content of any such depiction, and we have no contractual relationship with the people appearing in it. What we hold is text: a machine-generated transcript of the spoken audio of a video that is publicly available elsewhere, together with the information needed to link to the moment in it.
The exclusion we rely on
28 C.F.R. §75.1(c)(4) provides that the term “produces” does not include the provision of an internet information location tool — that is, a directory, index, reference, pointer, or hypertext link — by a person who does not otherwise engage in producing. That describes this site: it is a search index over transcripts, and every result is a pointer to material on the third-party site that hosts it.
The obligations under §2257 and §2257A, including the obligation to obtain and maintain records of the age and identity of performers, rest with the producer of the material and with the site hosting it. Enquiries about records for a particular video should be directed to the platform on which that video is published; the link from any result here names it.
Age of performers, and what we do about it
We index material from platforms that operate their own age-verification, consent and moderation regimes, and a video removed at its source stops resolving from our links. That is not a substitute for the records we are not required to keep, and we do not present it as one — it is the reason we index those platforms and not others.
If you believe material indexed here depicts a minor, or depicts anyone who did not consent to its recording or publication, report it and we will remove it from the index. You do not need an account and you do not have to identify yourself. See DMCA and takedowns. Reporting it to us is not a substitute for reporting it to the relevant authorities, including the platform hosting it.
